At SmarterLEGAL, we typically handle uncontested divorce cases (simple divorce) for an affordable flat fee. Please note we do not handle contested family law matters such as contested divorce or child custody cases.
What is an uncontested or simple divorce?
There are generally two types of divorce: Contested and Uncontested. Uncontested divorce is simpler, less expensive, and generally moves through the system a lot faster than contested cases.
- CONTESTED DIVORCE - is one in which the parties cannot agree either about getting divorced, or about the terms of the divorce (division of assets, allocation of debts, alimony, child support, or the custody of children).
- UNCONTESTED DIVORCE - is one in which the spouses agree on the terms of the divorce and do not need the court to divide assets or make determinations about support or custody. In general, an uncontested divorce is simpler and moves through the court system faster and more efficiently than a contested divorce.
However, as you may know, the divorce process - even an uncontested divorce - requires a lot of confusing legal work. Our attorney typically handles the entire case for an affordable flat rate of $1750, which includes ALL court costs and fees. It also can be broken down into two payments (one at the beginning and one at the end).
